Terms of service

Draft — not legal advice. These pages describe how we intend to operate. They will be reviewed and finalised by external counsel before public launch (spec §12). If you are a user or broker on a pre-launch build and have a question we haven’t answered, email privacy@brokercompare.example.

What BrokerCompare is, and isn't

BrokerCompare is an introduction service. We help boat sellers find a broker who is likely to sell their boat well, we rank brokers by independent performance signals, and we pass the seller’s details to the brokers the seller picks.

We are not:

  • a yacht broker;
  • a buyer or seller of any boat;
  • a valuer (your broker handles pricing — our ranking is not a price opinion);
  • an escrow agent or a holder of client money or deposits;
  • a survey, insurance, finance, or transport provider.

Any valuation, survey, sale negotiation, deposit, or completion is between you and the broker (or other professional) you choose to engage.

No financial-regulation exposure

We never take custody of deposits or sale proceeds. Buyer deposits and sale proceeds stay with the broker’s regulated client account (per ABYA / IYBA / HYBA / MYBA standards) or with a third-party escrow provider the parties choose.

We are not authorised by the Financial Conduct Authority and we do not give financial, tax, or legal advice.

Who can use the service

You must be 18 or over and the legal owner of the boat you are asking us to find a broker for (or be authorised to act for the owner). The service is intended for non-commercial yacht and motorboat sellers.

Seller terms

  • The service is free to sellers. We don’t charge listing fees, subscription fees, or success fees.
  • We share your details only with brokers you explicitly select on the matches page.
  • Once a broker contacts you, the terms of any listing agreement are between you and that broker. We are not a party to that agreement.
  • You agree the information you give us (boat details, name, email) is accurate to the best of your knowledge.

Broker terms

Brokers admitted to the platform agree to the following commercial defaults, configurable per broker in writing:

  • Referral fee: 15% of the broker’s gross commission on a completed sale of a boat introduced by BrokerCompare, subject to a per-currency floor (€100 / £100 / $150 / ฿5,000 — see config/currencies.ts).
  • Payable: within 7 days of completion. We invoice via Stripe in the broker’s local currency.
  • Late payment: after 30 days suspends the broker’s visibility in seller results until the invoice is settled.
  • Vetting: brokers must hold a membership of a recognised trade body (ABYA, HYBA, IYBA, MYBA, APSA), or hold a regulated client account and pass our independent due-diligence check.
  • Ranking: we determine broker ranking by objective signals (sold-price ratio, days on market, comparable volume, verified post-completion reviews). The ranking method is published in our methodology guide.

Reviews

Seller reviews on the platform are tied to verified completions only — we do not accept unverified reviews. Brokers may publish a written response to a review. We reserve the right to take down reviews that breach the law or contain personal attacks unrelated to the broker relationship.

Acceptable use

You agree not to:

  • submit false boat or contact details;
  • scrape, mirror, or otherwise systematically extract content from this site;
  • attempt to reverse-engineer the ranking algorithm to game it as a broker;
  • use the service to spam brokers or sellers.

We may suspend or close accounts that breach these terms or that appear to be operated by a bot.

Intellectual property

The site, its content, brand, and the ranking methodology are owned by BrokerCompare. You retain ownership of the data you submit; you grant us a worldwide, royalty-free licence to use it to provide the service and to share it with brokers per your consent.

Liability

We do our best to surface accurate, performance-ranked broker matches. We do not guarantee a sale, a sale price, or the conduct of any broker on the platform. Your contract is with the broker, not with us.

To the maximum extent permitted by law, our aggregate liability to you is limited to £100 — the service is free to sellers, and brokers’ remedy is limited to refund of any referral fee paid in the prior 12 months. Nothing in these terms excludes liability for fraud, death, or personal injury caused by negligence.

Suspension and termination

You can close your account from /account at any time. We may suspend access for breach of these terms, abuse, or non-payment (broker side). Sections relating to liability, IP, and governing law survive termination.

Governing law

These terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English courts, except where local consumer law gives you the right to bring a claim in your home jurisdiction.
